When Hiring a Lawyer, It's Important to Find a Specialist

The days of the legal generalist are over. While there are still lawyers who offer to do any kind of work that comes their way, the complexity of the legal system and the complicated lives we all lead almost require that prospective clients shopping for a lawyer look for someone who specializes in their type of legal issue.

Attorneys can range from corporate and real estate lawyers to those specializing in social security claims, workers compensation appeals, labor disputes, and personal injury law. Each specialty requires an understanding of state and sometimes federal laws and regulations that define how any dispute will be decided.

So how do you know which lawyer to hire? First, you need to understand what issue or issues you are facing. Some will be easy to define; if youve applied for social security disability insurance and been denied, for instance, you need a lawyer who deals with federal disability issues.. If youve been injured in an auto accident, the issues can be more complex. You may have to deal with your health insurance company, your auto insurance company, the auto or liability insurance companies of others involved in the accidentwhich can sometimes be multiple partiesplus the police, hospitals, ambulance providers, and so on. You will need someone who can sort out all these issues and protect your interests in the process.

When hiring an attorney, you need to ask a lot of questions; for instance:

Does this case represent a specialty of yours?
How many cases have you handled on this issue?
How many times have you gone to trial over this issue?
How many claims have you settled out of court?
How many times have you won a case like this?
What chance do I have to win my case?
What type of financial or other type of settlement can I expect?
What will it cost me to pursue this case? Make sure you understand both the fee structure and other expenses, such as court filings, copying and telephone costs, and the many other expenses that can quickly add up.

Make sure you have someone with a track record for your particular type of case, and someone with a commitment to your interests. If you get the idea that your case will get short shrift, go elsewhere.

Criminal law is another specialty, and one with potentially high stakes. Thoughts On How To Create And Maintain A High Team Spirit

In previous articles I introduced some important criteria when choosing partners for your dream team. Here is a short recap:
Choose people you trust
Choose people you enjoy working with
Choose people who challenge you
Choose people that are hungry to learn
Choose people that are coachable
Choose people that are givers.
Choose people that share your interests and basic values.

This article gives you some ideas how to create and maintain a high team motivation and good team spirit.

So now you have a good team and you all proceed to do the daily job. In the beginning everyone is full of enthusiasm and go to work full of energy. But how do you keep up team spirit after the initial honeymoon phase?

Information is one key issue. Make sure to share information in your team! Everyone shall knows what is going on in your business. Regular meetings or telephone conferenses are the most obvious ways to exchange information, tips and tricks. Other possibilities are regular information emails, a common bulletin board or a forum. Email, bulletin boards and forum all require computer acces for your team members. They are also one-to-many communication, i.e. you do not know that every team member actually receive information and interpret it the way you want.

If you have meetings make sure to have them the same time and place with regular intervals. If you prefer telephone conferences have them on the same time, with the same telephone number and code and at regular intervals. Also remember to send out reminders to everyone.

Make your meetings/telephone conferences interesting! Invite external people every now and then! E.g. someone with experience from your business can tell an interesting story, news or new ideas.

Ask one of your team members to host next meeting/telephone conference! This will make your team members feel important while releaving yourself from the task of planning and hosting the meeting.

Acknowledge team members who did a good work or came up with a good idea! This will boost the spirit of the team member that gets acknowledged and encourage others to do the same.

Set individual goals for team members and have progress reports on the meetings! Nobody wants to report failure to reach a goal in public so it will make your team work harder to reach their goals!

Keep meetings and telephone conferences short and efficient! Let everyone have their say but do not allow prolonged discussions or nonsense talking. To chair such a meeting/telephone conference is a critical task so you had better practice.

A competition with a small price for the team member that achieves best results until next meeting is always a good possibility.

Arrange non-work related activities! Common lunch or dinner, a game of bowling, picnic, visit an exhibition... there are a lot of possibilities! It is much easier to work together if you know each other well and have fun together. This is also a perfect occasion to ask one or more of your team members to arrange next activity!

1) Will you be choosing liability coverage for demonstration or will you be transporting for demonstration?

3) Will you decide to have liability coverage for the work performed by you or your employees?
4) Will the boats you will be selling be covered on land or on the water, or both?

6) Will your boat dealer insurance cover all risks, such as floods, waves, and wind?
7) Will your insurance policy include excess liability coverage that will pick up other areas that are not specifically covered?

9) Will your insurance also cover used boats that you have accepted as trade-ins, or will it just cover your new boats that are in your inventory?

These are just some of the questions you may want to ask when you are interviewing several agents from several different insurance companies, so that they can cover their various insurance policies in detail.

Once youve narrowed your choices down to one or two insurance companies as well as one or two insurance agents, it is also wise to talk to some of their customers. By this, Im not talking about references, no insurance agent or company for that matter, will ever give you a reference that will tell you anything negative. Instead, it is better to find people on your own who have had experience with the insurance company youre considering doing business with.

It may be kind of hard finding people who have used the same agent you are considering, but you should at least be able to find someone who has used the same insurance company. If at all possible, talk to someone who has filed a claim. You knowing how an insurance company works during the claim and payment process are critical in your feelings of comfort that you have chosen the right company to do business with. You first need to find out about the kind of coverage the person carried. Next find out how accessible their agent was during the claim reporting process. Finally, find out if they had disputes with their insurance company or if the claim was settled promptly.

In conclusion, make sure you steer clear of insurance companies with a reputation for delaying or denying claims. They may look like the best because they have the lowest rates, but theyre probably keeping them low by denying legitimate claims as well as giving their clients the runaround over what they will actually cover in the event of a problem.

Losing weight is not just about taking whatever claims to help you do so. It's also about making sure that the weight loss product is approved and tested. Top Ten Reasons Why Men Don't Want To Learn The Alexander Technique

The Alexander Technique has been in existence for well over a hundred years and it has proved tremendously successful in helping people overcome back pain, breathing problems, poor posture and stress. So why is it that more women than men choose to learn it?

1. The majority of Alexander teachers are women. So what if F.M. Alexander was a man and, to be precise, a mans man? A rugged individualist with an enduring love of horses and horse racing, he developed his Technique because it was his nature to be proactive and contribute to the solution of his health problems. Regrettably, he also had his sensitive, intuitive side, and this is shared by a lot of women (and men) who have since trained in his Technique.

2. Alexander teachers are vegetarians who do yoga and want to save the planet. As a breed, AT teachers are socially responsible. Still, there are plenty of red meat eaters among them. There are also sports people, martial artists, musicians, actors, body builders, computer nerds Overall, theyre rather like the rest of the population. (They can even be sexist at times!!!.) But theyre committed to helping people maximise their sense of physical wholeness and well-being.

3. Real men prefer to tough things out. Why, when some professional output could make it so much easier for them to achieve what they want? But then, real men dont go to the doctor. They may complain, but they can put up with pain and limitations of movement. Learning the AT it would mean learning different ways of thinking, and going, about their everyday physical activity. It could mean making an enduring commitment to their physical well being.

4. Real men dont do self-care. Men do health and fitness; women do self-care. In fact self-care, far from being fluffy and flaky is about broadening your vision and developing your health and fitness strategy so that it best meets your goals. The AT can help you keep meeting those goals long-term, without boredom or injury. It can also give you a broader perspective in other areas of your life.

5. Real men dont do alternative therapies. How many men do you know who are up for colonic irrigation??? In reality, the AT is not a therapy, it is a progressive re-education in the art of activity without injury. So people who learn the AT are not patients or clients, but pupils which might be even worse. Also the AT is not about getting it right (or wrong), so it doesnt foster the competitive spirit.

6. Its not macho. The AT is not like football. It is not practised in a pack, in a noisy, smoke-filled, alcohol-fuelled atmosphere. It is practised one to one, with a Teacher who is sensitive to the pupils individual make-up. An AT teacher is attuned to the pupils body and encourages the pupil to become increasingly aware of how they can maximise their fitness activities while protecting their body from wear and tear.

7. You cant work off your aggression that way. Absolutely right, but it could help you reduce it, more or less spontaneously over time. The AT reduces stress levels and can make you feel good about yourself. It teaches you how to undo muscular tension. The knock-on effect is that physical the freeing up makes most people able to divest themselves of a lot of psychological tensions, surprisingly easily.

8. It could involve deferring to your partners superior judgement. There are plenty of men who slump in an armchair and say to their partner: Your postures terrible. You really should do something about it. They may even be right. But The Little Woman cant be expected to know whats good for you. She might have problems, but youre fine just the way you are. Different rules apply.

9. It could make you look better. Sure, youre committed to going to the gym and working out. The Alexander Technique wont give you a six pack, but it will get you looking taller, straighter and broader across the shoulders, even leaner; so you can get a huge return on a very small outlay of effort.

10. You cant get up a sweat doing it. Unfortunately you wont need a good shower; so it wont result in extra bear hugs for your partner. Sad because sweaty men always seem to be affectionate men. Nor will you wake up the next morning with aching muscles. But you may find that you look taller, straighter, broader and even leaner. Its not a more is more thing. Its about achieving maximum results, in the gentlest, subtlest way possible.

Problem With Your Vehicle in California? Know More About the California Lemon Law

Lemon laws are U.S. state laws that offer remedies to consumers for products such as boats, cars, computers, motorcycles, refrigerators, RVs, etc. that frequently fail to meet the set standards of quality and performance. These products are commonly referred to as lemons. There are both state and federal lemon laws that protect the interests of consumers. The rights afforded to consumers by lemon laws may exceed any warranties expressed in purchase contracts.

The California Lemon Law states that if a purchased vehicle turns out to be defective in the warranty period rendering it unfit for use or inflicts some serious injuries to the user, then the consumer has every right to ask for refund or replacement.

If you purchase or lease a vehicle in California and then discover that it has defects that substantially affect its safety, use or value, California State Lemon Law may help you gain satisfaction from the vehicle's manufacturer. Under the California Lemon Law, new cars, leased cars, pre-owned cars, RV's, motor homes, motorcycles, boats and other consumer vehicles qualify for protection if they were accompanied by a written warranty. While the law cannot help everyone with a "lemon", and some people may have to hire an attorney to get their cases resolved, the law does create important rights for the consumers.

Circumstances in which the consumers seek protection under California Lemon Law:

The defect of the product is a manufacturing defect
The vehicle has been repaired at least four times and still the defect persists.
The defect is detected but not repaired within the period of 18 months or 18,000 miles.

There are several steps that the consumer must take to effectively use the lemon laws of California State. (1) Keep a detailed repair record, complete with dates of the repair attempts, when the vehicle was out of service, and a list that explains exactly what the trouble is, such as "cutting off" or "stalling"; (2) send a certified, return receipt requested letter to the manufacturer's consumer relations office and the manufacturer's nearest regional office listed in your manual; (3) after you have followed the previous steps and met the criteria as defined by your state's lemon law, request a refund or replacement, less depreciation, of the vehicle.

Differing from some laws in other states, the California Lemon Law allows unsatisfied car buyers to sell the defective vehicle, or to trade it in for a different automobile. To preserve the consumer rights outlined in the California Lemon Law, vehicles with warranty defects offered for sale must be accompanied by a written disclosure that declares the owner is aware of the automobiles defects (a written statement from a professional inspector is better), and the vehicle's manufacturer needs to be notified of the unsatisfied buyer's intention of sale or trade.
